It's the crime that matters here, brutal and unjustifiable - consenting adults who wish to partake of certain practices in a place like that is a wholly separate issue.

you can't blame a room; rooms aren't usually what you would call lawful or unlawful. What people do in them is another matter. It would have been just as bad if they'd done it outside in the sun.

Although these men clearly knew what they were doing, someone could have been duped into going along with this and actually rape him not knowing it was real. S&M between consenting adults (within reason) has no reason to be made unlawful. One should not impose one's (dis)tastes on another. So there is no reason a room used by dominants & submissives would be unlawful either.

It was illegal in R v Brown and Others because even though they were all adults and consenting they went too far. Nobody complained, it was discovered when the police raided the home of one of the participants on a totally unconnected matter and found videos of the acts.

The acts in this case were extreme and whether or not the five men should have been convicted is still hotly debated.

So, the rooms can be licensed and lawful, S&M and bondage is lawful amongst consenting adults but there is clearly a limit. I am undecided as to whether an event that led to the death of a consenting adult should be treated as murder, manslaughter or death by misadventure.
