Using Someone Else’S Phone With Intent To Deceive
Is it illegal to send messages from someone else’s phone without their knowledge, giving the receiver the impression that the messages have been written by the owner of the phone?

it depends on the facts ( content of messages )
if the message says something like Trump is not a good roman catholic then there is not much liability
but if Philip Mould ( he of antiques' roadshow ) is accused of trading insolvent and being a lothario - then the cat fur flies
