Building On Common Land

My neighbours are having work done on a piece of land very near to my property.
I have also just been informed that they are going to have a path built across the Common Land at the bottom of my garden.
The Council have been 'sniffy' about that land since I've lived here, so I just planted some blackberries for my wine.
I just want to know the law concerning building a path on Common Land, really?

(He can't normally exclude the 'right to roam' though). So the first thing you need to do is to find out who owns the land and whether or not they've given permission for the path to be built (or, indeed, for the planting of blackberries!).
