What a joke, 26 weeks. If that isn't a miscarriage of justice what is? Disgraceful.
Thank God no-one was seriously injured by this woman's appalling actions.

Both lucky to get out alive. Her luck continued when sentenced to only 26 weeks.
I know that bit of road very well indeed - it's normally extremely busy so it's a minor miracle no one was seriously injured or killed by this idiot's madness.
Why only a three year ban? Surely in cases like this it should be a lifetime ban?
Absolutely Talbot. I wonder how much the sentence had to do with taking her child to court with her? Smart move perhaps?

The problem with cases like this is that you end up punishing the kid too, so the beak may well be thinking of that. The poor kid is punished enough already by having a radio rental mum!

True TTT. But sometimes the best place for a child may not be with its mother.
Her brief probably told her to bring the child to court, defence lawyers use every dirty trick in the book to get their scumbag clients off with a light sentence ! Don't know how they sleep at night sometimes...
I couldnt see where it said she took the child to court. I would be extremely surprised if the child had been allowed in.

And MOST defence lawyers will have said "Do not, under any circumstances bring that child to court with you and if you must make sure there is someone with you who can look after it".

Equally, most defence lawyers defend their clients to the best of their ability within the regulations laid down by their governing body - no more no less. And most of them sleep very well at night, in bed.
I guess it's because they have no conscience ...

Let’s have a look at the guidelines:

For dangerous driving to attract a sentence of more than 26 weeks (the maximum a Magistrates’ Court can impose) it has to involve the following:

“Prolonged bad driving involving deliberate disregard for safety of others;”

As bad as the driving which led up to the accident seemed, there may not have been any evidence of prolonged bad driving. However, the offence is severely aggravated by the high level of alcohol recorded and the fact that a young child was on board. Further, the accident was horrendous and could have led to multiple casualties. My view is that the offence attracts a far greater sentence than six months custody and the Magistrates should have committed the defendant to the Crown Court for sentencing.

Little consolation, I know, but she is classified by the DVLA as “High Risk” Offender (having recorded more than 2.5 times the legal alcohol limit) and they will undertake enquiries before returning her licence. She will also (by virtue of the Dangerous Driving conviction) have to take an extended re-test before being allowed back on the road. The downside is that of her 26 weeks sentence she will serve just 42 days inside before being released to serve another 42 days under the “Home Detention Curfew” scheme. All in all, a hopelessly inadequate sentence for an episode of extremely dangerous drunken driving.
All I can say is that she will be uninsurable once her 3 year ban is up and she gets her licence back. As NJ says she may never get her license back as it may well be decided she is too much of a risk.
She does drunken stunt driving with a child in the car Eddie, I doubt insurance looms large in her plans for the future.

She'll do what she wants cos she has a right.
^ I agree but I think the police and the DVLA will look very closely if she ever does get her licence back. They will be on the lookout for her in case she tries driving while disqualified as well.
