Can You Get A Ccj On Tenants For Rent Arrears While They Are Still In The Property?
I have issued both a Section 8 and a Section 21 to a tenant who has 4 months of rent arrears. This hasn't gone to court yet. I was wondering if I could also issue him with a CCJ before he disappears.

you can join the eviction under s 8 with a claim for arrears
( used to have to be separate but the rules changed)
s 8 is discretionary and involves a hearing if defended and is herefore slower
s21 is much quicker as you have an almost absolute right to possession - so as I usually suggest - I would go for s21 as it is quicker - get the tenant out, redecorate relet and get on with your life.
I have written off most arrears (bar one)
altho one is gamely paying off since Nov 2011 ( what did I say ?) and that is because the professional regulator takes a dim view of unpaid debt.
a lot of landlords obsess about arrears - it isnt worth the effort
get them out quickly - see cassa's threads
