Hi I got done for three points and a fine under MS90 - failing to identify a driver, Does this mean that I have a criminal record now? Is it the same as the thread posted on speeding (i.e. SP codes)?

It means you have a motoring conviction, not a criminal record.

Why on earth didn't you identify the driver?

Thanks Ethel, couldn't identify the driver - long story! I've been asked by my employer to fill in a form asking if I have ever been convicted of a criminal offence - do I need to say yes now?

Strictly, motoring convictions are criminal convictions and so all have rehabilitation periods. Most people convicted of motoring offences are fined and have their licence endorsed, so the rehabilitation period in most cases will be five years, or two and a half years if you were aged under 18 at the time of conviction.

However, apart from serious motoring offences such as drink driving, details of most motoring offences, including speeding offences, are held by the Driver Vehicle Licensing Agency (DVLA) in Swansea and local police forces, rather than on the Police National Computer. Because of this they generally will not show up on a Disclosure certificate even if they are unspent.


So in practice you would say you have no criminal convictions

Brilliant thanks Ethel, much obliged. I think I will declare it beacuse as you say it is a criminal offence and the question was "have you ever been convicted of a criminal offence" so I think to be on the safe side I'll 'fess up!

I don't imagine it will be a problem as I gather it is the same type of offence as speeding i.e. a fixed penalty and if it doesn't constitute a criminal offence i'm sure it will be o.k.

Lesson learned though!
