The Scottish NHS is a separate entity from rUK NHS and therefore comes under the remit of the Scottish government - so yes.
As for visitors to Scotland, no doubt they will treated in the same way as other countries that have an opt-out scheme, like Belgium.

this is nothing to do with the NHS, it needs a change in the law. What if you are not in an opt out scheme?
Already happening in Wales, I believe.
Funnily enough the Scottish government has the power to make laws too, being you know a "government". I imagine the numbers of visitors to Scotland that are travelling alone, without identification that have a fatality would be tiny, however it has been done in other countries so it is possible.
Yes, already in Wales and I wolud like to see it in operation in England.

I would also like to see those in the opt out as bottom of the list for a transplant only receiving an organ if every suitable 'in' person has been checked first. It would not be difficult to do.
Who do you think looks after the transplants if not the NHS? It's a devolved matter so of course the Scottish Parliament (notice the lack of quotation marks?) has the powers.
