Presumably because there were no loopholes for hm to exploit, even with Mr Freeman's skills. Although originally pleading Not Guilty Mr Saunders changed his plea before his trial was due to be held. It seems the District Judge must have held that the offence fell in "Category 1" (the most serious). For this Mr Saunders must have demonstrated a deliberate refusal to comply and that his impairment was substantial. The starting point for such an offence is twelve weeks, I imagine he was given some discount for his somewhat late guilty plea.
I note he has appealed his sentence and his legal representative will go before a judge today in an effort to have him released pending his appeal. If his appeal fails he will serve just 28 days. He would automatically be released at the half way point (35 days) but is then eligible for "Home Detention Curfew". This sees another quarter of the sentence served under curfew, but with a minimum custodial term of 28 days.

yeah been there and done that
asthmatic and couldnt give a breath test but I blew and blew !
