Not new - it's s.12(1) Theft Act 1965
Mistype - Theft Act 1968

a person shall be guilty of an offence if, without having the consent of the owner or other lawful authority, he takes any conveyance for his own or another's use, or knowing that any conveyance has been taken without such authority, drives it or allows himself to be carried in or on it.
It means allowing themselves to be carried in a vehicle that had been taken without consent.

LOL....I had to read it a few times to determine who or what "taken without consent " was alluding....the vehicle or the person.
Years ago it was TDA. Taking and Driving Away.
In simple terms ‘nicking a jam jar’ ( motor).
Now we have ‘ Taking a vehicle without consent of the owner’
That will encompass naughty boys/girls/ brats taking mum or dads car for a spin with their mates whilst mum and dad are on holiday. Not real theft with intent to permanently deprive. :-)
The "Taking without the owner's consent" or TWOC was introduced because theft of a car means intention to permanently depriving the owner of the car.

As joyriders don't intend keeping the cars, they had been escaping prosecution so the TWOC was added to the Act.
Don't pile all youngsters into the same boat. Some youngsters are sensible, studious and go on to lead productive lives. Others are wrong uns from the start. I guess its been like that for centuries.

As advised, it is a legal defence whereby the passengers can claim that they were unaware that the vehicle was stolen, and the burden of proof then lies with the prosecution.
That's not the defence, that's the charge.
hc - The accused advising that they were unaware that the vehicle was stolen is their defence.
