How can a judge instruct a jury to bring a guilty verdict? Surely this is then not a fair trial Can the jury overide the Judge? Also why can a name be witheld due to legal reasons, who makes this discision, and what are the legal reasons?
The name of the defendant may not be disclosed for various reasons, including the age of the defendant (if he is a minor) and to protect the identity of the victim.
The latter example could be when a man is charged with raping his very young daugher - naming him would clearly identify the victim.
Or if the defendant is likely to be tried in the very near future for a different offense - naming him could prejudice the jury.
