In order to execute a power of attorney he must have the mental capacity to manage his own affairs. Once a poser of attorney iks executed, provided it is in the form of an Enduring Power of Attorney it can be used straight away, but if he then becomes incapable of managing his own affairs the Power of Attorney msut be registered with the Court of Protection.
