I recently bought a car from a dealer. It was advertised as having 2 keys. However, when he delivered it he said he had "forgotten" the second key and assured me he would post the second key to me. He has not done so and keeps saying that he will but never WHEN. As I have paid in full for the car, the key is legally mine so, is he committing an offence by withholding my property from me?
he would be if he had it, I suspect it was BS. You could get another made and send them the bill and enforce via small claims but you would need evidence that 2 keys were promised.
Thank you Tora x3 I have proof. I printed the ad from ebay and sent all messages through there as well. He hasn`t denied having the key, but just will not send it. Will send ultimatum tomorrow and then contact ebay, for all the good that will do. But, it`s a start.
I hadn`t thought of that, Bookbinder, but, he is more than 100 miles away so I`m HOPING he wont come sneaking back in the middle of the night with a low loader !! :)
In order to be convicted of theft, a person has to be shown to have intended to permanently deprived you of your property. Tardiness in handing over your property is therefore only a civil matter, not a criminal one.
Find out the cost of getting a new key cut and coded and advise the dealer that you will be billing him for that amount (with court action through the small claims procedure to follow if necessary) if he fails to provide the key within 14 days.
The website says they are closed but they are still selling as I bought mine during lockdown and it was delivered during lockdown. However, it is too far for me to go and collect the key.
