Two gardens away, our neighbours have a very high eucalyptus tree which is a great deal higher than thier house. Both the occupants of the house next door and ourselves are concerned that one day...................
Have we any right to have the tree felled or at least trimmed ?.
Is there not a law which states that you are entitled to 'prune' anything which overhangs or overlaps your property and place the cuttings back in the garden to which they belong??
Yes you can trim anything overhanging your garden and there is an ancient thing about 'offering' them the cuttings .... but as for cutting it down you have no rights at all.
thanks for your quick replies. yes, I seem to remember that you CAN prune any overhanging branches etc, but you MUST give them back. As there are many overhanging branches in my neighbours garden, maybe if I feed him this information he just might inform his neighbour of his intentions, tell him why and it might prompt action to reduce the tree in size. There's one type of Eucalyptus tree that is called 'The Widow Maker', i'm not sure which, but its so called, because every so often, it sheds a branch, you want to try and find out which one your neighbours have, for their own safety, as well as others.
I suppose if you're really worried about the safety aspect you could contact the local council. They all have a 'tree man' who can decide if it's likely to pose a danger.
