Oil Tank Regulations

Very concerned about our oil tank. It is on a brick pedestal which has begun to subside and it is now leaning very obviously. Worse it is leaning against a fence - on the other side of which is a large septic tank belonging to a housing association.
It needs draining, the pedestal rebuilding and then replacing - because there is nowhere else in our very small garden for it. It is in a tiny space behind the garage (where the boiler is situated). Someone has said that we won't be able to replace it there because of new regs. re. distance from buildings. We're now very worried because I can't think of anywhere far enough from a building. We have no other possible form of heating, nor a lot of cash.
Does anybody know the current situation, please. It would help just to know the worst really.
