about to apply for another job, the only thing stopping me is the new place contacting my boss for a reference. Are teyaloud to do this beofre offering you the position????

Yes - and some will.

But many will not - typically they will offer you a post subject to the reference proving satisfactory. They then withdraw the offer if the reference is not good enough.

They should tell you which system they work to.
They are quite entitled to ask for references --- previous employer cannot give you a bad one , but can refuse if you have done something untoward, and this may be taken that you maybe unfit for the job
A lot of places will be fine if you specify that you do not want a reference taken before the job offer is made
