my house is a crime scene , been told by police cant live there due to arson . morgage became in arrears. now morgage company wants the house back , insurance have said dont touch any thing , they wont talk toeach other . well my claim be invalidated if the house is repossed and who well be liable for he damage to my property inside and out at y wits end .. mt ex husband has been arrested ...someone help

not good news regarding the Mortgage. If you stop repaying the loan they will want to know why and start proceedings to recover their money. The facts of the fire and the habitability of the property does not "let you off the hook" with the Mortgage lender. They secured their loan against the property, but it was a loan of money that has to be repaid.

If the property were to revert to the Mortgage company because they wished to recover their loan, then any insurance pay out with respect to that property not yet made will be part of their ownership of the property. If you had insurance on the contents that is a separate issue.

Best advice it to get back on good terms with the Mortgage lender and make an arrangement to pay the arrears and catch up with payments to prevent the transfer of the property to them.
The lender cannot get possession without an order of the Court who will determine whether all steps have been taken to deal with the matter. Work with the lenders here who should be in a position to give you the help you need if the circumstances are as you describe
Do you have any insurance that may pay the mortgage payments ? The building society's view is that if you are still working - why is the mortage not being paid ? Just because you don't/can't live there doesn't mean you should stop paying the mortgage - the gas and electric - OK they'll wait and same with the council tax - declare it uninhabitable and they'll suspend it. You don't say as why the mortgage fell into arrears is it because your money is going into a rented property ? If so you can get the rent back on your insurance and use that money to pay off the arrears ! If the property is mortgaged your buildings insurance will pay for the damage to the property itself and your contents insurance will pay for the contents and fire damaged posessions.
All mortgaged properties are usually required to be covered for fire and damage however caused as part of the terms of the mortage so this situation is unusual
