I left my previous employment 3 months ago I have received a letter this week stating that they overpaid my holiday entitlement by 450 and that they want the money back, this was an error on their part and I did not realise I had been overpaid until just receiving this letter. As it was 3 months ago I have now spent the money. I have offered to pay it back at 20.00 a month but they have sent a further letter requesting me to fill in an income and expenditure form together with 3 wage slips from my new employment. As this is their error can they force me to tell them personal information especially as I have offered to pay them back. What do I do next please help?
If I were you I'd re-iterate your willingness to repay at the sum of 20 per week but decline to give them any details of your wages etc, as they are in no way entitled to that and it's none of their business. They really won't want to take you to court for it, too much hassle and so forth, plus you've already offered t pay them so they'll likely accept your offer. Be quite "take it or leave it" with them and see how you go.
They could sue you through the Small Claims Court and an attachment of earnings order could be made, that would mean disclosing the earnings details anyway. An order made against you will also affect yir credit rating. If I were you, I'd make a more reasonable offer.
