My husband has been suspended from work after having a serious allegation against him. But no one has told him what this allegation is, they just said they would contact him in due course. He has also been suspended on full pay, is this legal ?!
It will be set out in his Terms&Conditions of employment.. But yes, this is legal. They have to pay him his full wage until an investigation has been completed into the allegation. He will be written to in due course regarding the allegations and then be given the opportunity to attend a hearing with a witness of his choice to hear them and to defend himself.
Natural justice dictates that any accused person must be told what is alleged against them before any tribunal or group deals with it. Do you have a union?
under the recent conflict resolution legislation he is entitled to have in writing what he is accused of then be accompanied to a hearing and the right to appeal.if he does not agree with outcome. they can suspend on full pay legally and it doesnt mean they think he is guilty but for gross misconduct that is normal practice and they also would want to investigate without him getting in the way of that. He should try and get union rep if he has one or go to ACAS
