the goverment
hi , my mother-in-law, sadly has been in hospital due to the fact she is depressed, to cut a long story short , i think my mother-in-law, and father-in-law, are going to have to move into a home (soon) they own their home ... we obviuosly dont want the goverment to have any of the money from the house , how do we go about it so my partner and his brother can claim the proceeds of their home legally? thanks in advance

The NHS will pay for nursing care on top of this separately directly to the home. It is expected that property should be sold to finance this. I speak from resent experience as my father had to go into a nursing home following a massive stroke and as his power of attourney I had to make the payments from his funds. Sadly he passed away a few months ago just before we had to consider selling up his house. I wished he had enjoyed his money rather than saving it but that seems to be the way with older people who have spent their lives scrimping and saving every last penny.
dantheman's idea won't work. Social Services would investigate what had happened to the house and they have power to refuse to fund the care home on the grounds that the money (from the house) should be used for the care.
This is a common problem and there is probably not much you can do about it. A call to the Nursing Home Fees Agency might clarify things for you.
