If someone is saying they sent something (and this is what I cant believe, as the item was "sent" just after or on the 21st of December, and the Post Office have alledgely confirmed it was delivered before Xmas (but cant give a precise date) - wasnt the date for last post the 19th/20th - and so couldnt have been delivered in time for Crimbo??)
anyway the Ebayer is saying they will refund me the money back - surely they are under a "contract" to supply me with the item - even if it means they end up out of pocket?? But what can Ebay do to enforce that?
Though at this stage I think Id just be happy to have the money.
What do you think?

surely it will be better just to take the money and then leave the right sort of informative (not insulting) feedback for others rather than enter into a battle with them over contracts. besides Im sure that any 'contract' was to supply you with the actual item you bid for and they have been incapable of doing so.
I had this with a laptop allegedly signed for by me.When I insisted the other party fax me a copy of my supposed signature and it turned out to have been delivered to the completely wrong address. and somebody else had signed for the laptop and taken it in ! If they insist you signed for it ask to see a copy.
The seller cannot replace an item if he doesn't have another one.
eBay will do nothing to enforce the contract. It would be impossible.
A full refund is fine, and does not deserve negative feedback if the seller has behaved courteously throughout.
If it was sent by recorded or special delivery, ask for the tracking number. You will be able to see online the date it was delivered.

I had something delivered to me on 23 dec that was posted on 22 dec, so you cant really use the last posting dates as evidence.
In my experience, ebay are useless when it comes to supporting the buyer. so i would say always pay by paypal for any amount that you cannot afford to lose. You are covered by them, though even paypal do not have the best customer support either. At least then though you have your bank to fall back on if you need to claim.
I would say accept your refund as it appears the seller is being very co-operative :-)
