You would be prosecuted for either using/keeping a vehicle without tax or failing to display the valid tax disc.
And the law does come down very hard on this. It is to stop you buying your tax 2 weeks early and displaying it on your Jaguar, whilst using the old but still current disc in your Allegro that has no mot, tax or insurance.

Well obviously your example is evasion of road fund duty.
In my example I did not imply that any evasion had taken place or was attempted.
In this case I think the chances of anybody trying any prosecution is vanishingly small.
There's an element of common sense here. I was once stopped in one of these tax checks and asked if I had a tax disk - somewhat confused I looked to where it was and saw it had come unstuck and fallen down. So I put it back and that was fine.
I wasn't dragged kicking and screaming from the car handcuffed and charged with not displaying a valid car tax.
I'm also willing to bet good money that you're unable to find a single instance of someone prosecuted for displaying a tax disk early when there's been no attempt to evade the duty.

Well I was chatting with the ol' man about this last month. He said I could put in the new tax disc before the old one expires (I am talking just days left here).
Anyway, I took out my new disc on New Year's Eve, and when I parked up, I stuck the new disc in there. If the Police pulled me over for displaying it too early, I would laugh at them and ask why they're not chasing the people displaying no tax disc!!
Anyway, I renewed my disc online last month. You have to have the new style MOT certificate to do it, but everyone will have one soon. Nice 'n easy.

The reason for not displaying the licence early is that it would make it too easy to miss out a month occasionally. Although 14 days is not allowed to renew a licence, it is rare for action to be taken during that period. Then you display the new licence 14 days early and you have free tax for one month in every seven. Of course this is all much less relevant now that records are computerised and the authorities have numberplate-reading cameras, but the old law remains.
