Another Speeding fine & Points question

I received a notice in the post a few weeks ago declaring i was photo'd doing 36 in a 30 zone. I filled in the form advising i was driving at the time and my licence is from another EU country. I have now received a follow up letter saying i should apply for a D9 counterpart licence so that the points can be put on my licence. Failing that the matter will go to the magistrates court.
I am a bit miffed as I was entering an industrial estate on a saturday morning and had just come into the 30 zone from a dual carriageway and was slowing up to approach a roundabout (where i guess the mobile camera was), but obviously as I was going more than 30 so I was technically speeding.
Any advice on what is my best option?

For more on marking an answer as the "Best Answer", please visit our FAQ.apart from the speeding,there is no law for you to change your licence to a english licence,unless you have been resident in this country for 3 yrs, the only reason the police are asking you to change it,is so they can fine you and give you the points,having a EU licence,they cant do anything to you and they dont like it,they will not take you to court as you are fully legal and allowed to drive in this country on your present licence.

I hold a foreign driving licence
A foreign licence cannot be endorsed with penalty points. Motorists who do not hold DVLA (Swansea) driving licences cannot be made a conditional offer of fixed penalty. Instead prosecution will proceed by a summons to appear before a magistrates court.
So, nil points, but a fine.
