I am aware that there will be a Company Vehicle Smoking Ban coming into affect in July 07 for England, which states that any pooled company vehicle will have to be smoke free. Therefore any company vehicle used by more than one person will be smoke free. Our company leases and provides staff with there own company vehicle, but they have sole us of it, thus meaning that they will be allowed to smoke in the vehicle (as discussed and advised by HSE, Smoke Free England and the Dept of Health).

But...our company wants to impose a total, blanket smoking ban in all vehicles . Problem is that all staff pay tax on there vehicle, as its a perk. If we impose a total ban, will this be infringing on their rights or breaking any laws. Im trying to find out before I have no option but to call our solictors!

If it is the company vehicle then I don't see why they can't state 'no smoking in our vehicles'.
