Without Due care and attention while towing

After being involved in a accident on new years eve, both my partner,and I have been summonsed for the above charge, She basicly pulled out of a clear junction while towing me, a car approched, started to slow, then sped up thinking I (being towed) would stop, he though he could jump in front of me as he didn't noticed we were towing, despite the brand new marked tow rope. I can understand my partner being summonsed, but why me? I had no control over the towed car.
Any help would be appreciated.

what do you mean you had no control over the towed car,of course you should have,you were steering it,how long was the tow rope,its both your duty to be as carefull as possible while towing or being towed.

Yes, I had control over where it goes, but it not as if I could speed up or stop to get out of the way, as this was a side impact. The other driver failed to see we were towing and hence expected me to stop.
its your duty,not his,to show him you were being towed,even by hand signals.
You need to use hand signals you proberbly dont know them so get out your highway code and learn them they can save your life or mayby have a towing sign in the back of the car
