landlord fails to clear is items from garage

when we moved into our rented house we were told by the landlord that he would move all his furniture and electric appliances out of the garage within one month.Five years later we now need the space in the garage so we contacted him and said that we would need the garage in about 7 weeks and asked him if he could remove it for us,he said no problem and six weeks later he said he would be removing it 2 days before the deadline.Today he has texted us and said that he does not want it anymore and that we will have to remove it ourselves---we rang the council and they said they would remove some items in 2 weeks time but not all of it.We now have the problem of paying somebody to remove it and we need our garage space urgently.We have allways payed our rent 2 weeks in advance and have never missed a payment,we also have had no gas safety certificate for the last five years and we have a list of 22 major repairs. what are our rights.

For more on marking an answer as the "Best Answer", please visit our FAQ.Sounds to me like you have a VERY lazy landlord. Is it a private letting, to you have a full rental contract. Does it go through a solicitor, or letting agency, there are many more questions that need to be asked before anyone can give you a definate answer.
From experience its not best upset a landlord unless you absolutley have to, things can turn very nasty very quickly (especially if its not a fully legal situation). I would recomend contacting the local Citizens Advice Bureau, and make sure have all you current paperwork with you when you do so.

Ok, with the tenancy you now have what is called a periodic tenancy. This is the same terms and conditions as your original 6 month tenancy except you can give him 1 months notice to quit and he can give you 2 months. Periodic tenancies are very common as they save on paperwork and costs after the initial term.
I assume you had an inventory when you moved in? And I assume the LLs stuff in the garage wasn't on this inventory? If it wasnt, and that the garage is actually for your use, then its not up to you to pay for the removal. Your LL should do this.
You have several options.....clear it yourself, at your own expense, tell the LL he has to clear it, tell him you will clear it but that it will cost �X and you'll deduct that from the rent.
The gas certificate is a legal requirement - by law the LL must have a gas check done annually by a CORGI registered plumber.

i would move out but the wife likes the area and she will put up with anything and lets anybody walk over her but its annoying me to hell that this landlord is doing this---we are prepared to let most of the fault go by but not the gas--i posted the gas question on another thread and was told that the test had been done incorrectly as well--it should take at least 45 mins and the test was described to me --he took less than 10 mins and did not do any of the items on the test.

to bring you up to date he rang us and said he would send a bloke out to clear it today ---he did not turn up so we paid somebody to clear it for us.i have now asked British gas to put us on a gas cover plan so at least we will have the gas system checked out and we will ask the council to possibly move us up the waiting list a bit.

for borg123,it seems the problem you have here is not mainly you,re landlord although that is a problem and if i had a landlord like that i would kick his a???.you need to convince you,re wife that it,s for the best that you do move out of this property.not just for you,re sake,but for you,re kids sake.if this does not hit home.then you need to get you,re kids out of there for their own safety and for you,re own peace of mind.and let the wife stay there if she likes this place so much.but do it for you,re kids.you will be a lot happier in the long run.
Landlords are legally bound to take care of all appliances and do safety checks yearly. Sounds like he is breaking the law and could be prosecuted!!!
