I have a problem. Last year I signed a one month short term tenancy agreement with my landlord. It expired after one month and my landlord never asked me to renew it. Eleven months later I am moving out and I owe them money for rent and bills. Does the original contract still apply, even though it clearly states in the agreement that it expired on a certain date? I'm starting to worry that legally I've been classed as a squater for nearly a year :S
You have a periodic tenancy - i.e. the original tenancy has lapsed. You have the same terms as the original tenancy except for notice periods to quit. The rent remains the same unless the LL has written to you to change it. You still owe rent and bills as if you were on the standard tenancy.
My understanding is that unless notice is given the tenancy agreement should and often does carry on regardless of it being expired in writing. There is a verbal agreement that yes you can live there if you are paying rent. If you have paid the rent then it's an agreement on your behalf. He should have given you notice by now and vice versa.
Have you paid any rent in the last 11 months. Why didn't he get the keys off you if you weren't paying rent ?
