Hi ethel i posted a question a couple of weeks ago and never noticed your reply. It was regarding an ex employee of a high st bank, breaking her breach of contract. yes she has been giving out personal information regarding the running of my account eg loans I obtained and salary. would you say this was a matter for the dpa.

I have no idea what penalty she will receive, however.
Inform the bank of what has happened too. If they are not interested, contact the ombudsman.

Hi Ethel, thanks for your reply. She left the bank about 8 yrs ago. The info she is giving out is on a witness satement she has given for an ex partner of mine who is trying to claim a beneficial interest in a property he sold to me 2.5 yrs ago. She has given no info regarding him having an interest, she has just given details about the running of my bank account when she was a 'bank official' where I held my account, discussing my salary etc and how I could'nt possibly afford a mortgage on what I earned!!!!!! I presume from that she is trying to claim I obtained my mortgage fraudulently - which is utter nonsense. Then she went into detail about loans I had taken out over the years.
My ex and I are now waiting for a hearing date from the LR so this witness statement will be read out in court and she may have to stand in court and be interviewed.

This is tricky. As she left so long ago she is not accessing data in the strictest sense.
She is certainly in breach of confidentiality, which of course would be a sackable offence, but as she is not an employee it is difficult.
You really do need a solicitor who may be able to force the LR to disregard her 'evidence'.
The ex could be in serious trouble too, for aquiring this evidence. There could be a very large fine.
It is far too complicated an area for me to advise - and rather than mislead you (or ignore you!) I will pass on this one.

Although you are not seeking compensation per se, they may be able to advise you of any other remedy such as an injunction to stop her, or point you in the right direction for advice.
