impounded motor cycle
8 Answers
Monday - Motorbike purchased;
Tuesday - Motorbike passes MOT;
Thursday - stopped by Mr Plod - he can't see a visor on the helmet, it is there; then proceeds to examine Motorbike.
Doesn't like look of exhaust pipe; checks B.S. Kite-mark and stamped number which transpires to be bogus ! Policeman decides that this invalidates MOT which invalidates Insurance which means an offence has been committed.........
Impounds bike which gets sent away to be kept as evidence and will be used in forthcoming court-case ! It will cost 250 to pay for retrieval of bike and is costing 12.50 per day to keep bike there. Bike is only means of transport.
What offence was committed ? What can be reasonably expected as outcome ?

The MOT test is a test of roadworthiness, your bike was roadworthy, how a bike can be impounded for a loud can I don't know.
You can ride a Bike with no visor on your helmet.
You need to get a solicitor and sue the police force involved.

I cant see how a bogus registration marks can invalidate the MOT certificate after all it was examined and passed the test, But you need to remember that the certificate is issued on the basis that the vehicle complies with all releavant test legislation and that in the opinion of the examiner is fit to be used on the road, But that doesnt stop you being stopped at a roadside check and your bike failed especially if you had altered it in anyway since the test (some people borrow tyres to get them through the test and then give them back) I know that lack of road tax invalidates your insurance and now it seems that the lack of an mot certificate does too,
I would challenge the decision because the policeman has overridden the decision of the authorised Mot Testing Station. If necessary get a solicitor on the job
