my partner was assulted the other night,the man came at him four times getting worse every time.the last time he came at him from behind him with a bar stool and hit him twice over the head,thankfully my parnter was able to fend off the third blow.my partner needed hospital treatment for a two inch gash on the back of his head and xrays on his shoulder.we think there are cctv cameras in the area that may have picked it up and we have a witness.can the man that did it be charged with gbh with intent without cctv and how long do you thing he would get if convicted?any replies would be very helpful cheers.

From what you have written it seems the man who assaulted your partner has committed an ABH assault as the injuries do not amount to GBH. He may in some circumstances, if proved guilty, receive a custodial sentence but may (depending on many factors) get a community penalty. CCTV is useful evidence but is by no means essential.

thank you,i didnt go into to much detail before but the man first came at him and they had words the man came again and there was a scuffle the third time the man went to punch him and told my partner he was going to kill him and finally came out with the bar stool and hit him from behind.the man has quite a lot of friends at the pub where it happens and im almost sure they would be willing to lie for him, we are worried that if they do this a judge might see it as well he has more withness`s to say he didnt do it then we have to say he did.i hope it wont happen like that because i would hate for this man to get away with what he done.my partner was at his doctors this morning and has been signed off work for a further two weeks because of it.he is also quite worried about the fact this man could very easlily do it again.
your partner can ask the owner of the CCTv cameras (and he has to find out who they are - read the nearest lamp post)
for the relevant bits of the film - involving HIM - the partner - under the Data protection Act.

I would go for it quite honestly - the most upright and amazing people lie, and the cameras don't.

There is a charge but it is not much

thanks peter, unfortunity the stores cameras surrounding where it happened are all facing the wrong way for us so we are waiting to hear about police cameras in the area.we are going to press charges and hope that the witnesses he might come up with will not lie and if they do hope that they will be found out.like i said before i would hate for the man to get away with it as if it happens again who is to say that it wont be a knife or worse that he uses.
