Damaged item bought on Ebay

Hi,wondering if anyone can advise.I have bought a second hand mountain bike on Ebay which has been checked by a reputable bike shop and found to have a serious crack in the frame caused by a frontal collision.The bike was 'lost at the National Hub in Coventry' for about a week and arrived with no packaging at all.(the seller has never actually told me if she packaged it properly) I have contacted her today and she says she thought it was fine and asks if it was damaged in transit? Where do I stand concerning a refund or claim?Anyone help?The damage is not visible to me and only discovered by an expert,so photos (which she has asked for) are a waste of time.Thanks in advance.

I imagine that if you cant see the crack, then the vendor wouldn't have been able to see it, so she sold it to you in good faith!! You win some you lose some!!

I bought an i-pod on ebay which turned out to be a very poor fake. I contacted the seller (who was very highly rated) and was ignored. As the item was not bought through pay-pal, i contacted their claims dept and they paid me back the money. they were very helpful and even though i contacted them outside the 28day period, they still processed my claim, however it did take a while.
My advice would be to contact the seller (through the e-bay message system so there is a record) and if you get no joy, contact the claims dept.

Ratter,I took the bike to be serviced at my local bike shop as soon as it arrived(which I was advised to do).It cost me nothing. Now I have the bike back,it's a very visible dent on the down bar,so the bike hasn't arrived in the condition it was supposed to but thanks for your answer.
The last thing I was looking for was damage,I was just so glad to get it after waiting 8 days for a 24 hour delivery!
