my son is currently on bail for abh he was emotonally abused by former partner and attempted to take his life former partner went to live with her sister but still continued to have a sexual relationship with him went out clubing and drank 12 half pints of cider and rang him on his mobile and told him what a terrible person he was and to kill himself but to make a good job of it this time my son went round to her sister and they argued she fell over and sister is saying he kicked her we are now elected to have a newton enquiry my son has moved back near to us and obtained a permanent job with our help and is recieving help from the mental health services is there anything else we can do to avoid a custodial sentence

It is very difficult to advise ongoing police investigations, but ABH is very serious and is normally when someone causes serious injury to another. All the mitigation (reasons) for the injuries affect the punishment. You state he may have mental health issues, all these factors will be taken into account. Custodial sentences are designed to punish offenders who have been dealt with for serious offences. You don't say if this is his first offence? is thier any history of the problems you state.
It is most important to advise your solicitor of the whole history and any written/ text messages phone calls etc.
However the court will only deal with the charges as detailed.

PS The prisons are FULL so the courts will look at other punishments at present.

my son has been in trouble before for common assault and he was cautioned six months before the offence. He is now undergoing anger management therapy and has now starting to address his problems We have a Newton enquiry this week but it does seem after all our efforts he may be sent to prison I will have no faith in the law and all its talk of reablitation they so much say they are working towards I know and so does he that he as done wrong but he feels so unsupported by the law at the moment Thanks for your reply will tell you the outcome
