Wife's/Occupier's Rights

I have been married for 10 years, I have two children, and I am getting divorced. I have lived in my father-in-law's house for the last 3 years with my husband - who moved out 2.5 years ago. Nobody else lives in this house except me and my two young children (both under 10 y/old).

My ex, and his father, have told me to move out. This is my home, my children have settled down here, and I have nowhere else to go. A friend suggested I have rights as an occupier over the house - is this true, and if so, what do I do? I can't afford a solicitor.

Hi there, im not sure how you stand ,but you must get a solicitor to help sort this out for you., you say you can not afford a solicitor, but if you are on low income you can get leagal aid, now what you must do is got round the solicitors in your area and you will find that a least a couple will do leagal aid, when you find one just make the appointment and im sure they will help you.hpoe this will help

To be honest I dont think you have a leg to stand on as neither you or your husband own the house.

Of course they have to give you adequate notice to quit the house.

What arrangement was made when you and your hubby and kids moved in the house? Was it a temporary thing or was the house given to you to use as you wished?

There was no formal arrangement or discussion about the house. The house was vacant so I moved in with my husband. It was for us to use as our home, indefinitely, and we never looked to buy/rent anywhere else. If we were happily married, I believe my father-in-law would have been content to let us live there as long as we wanted.

They have told me to leave the house. Do I have to wait for a proper notice, or do I just have to leave now? WIll I get arrested for staying here? I called the local CAB but they were very unhelpful. I also called a few local solicitors listed in the yellow pages but they do not deal with this sort of work (unless its privately paid) and I called the Law Society and left a message.
