home heating fumes

My neighbour has an oil flue to the rear of his property (attached semi): it extends to approximately window height on the first floor and is located next to our boundary wall. The fumes from this are very strong and make it unbearable be in my garden if his heating is running. What's worse is that I can't open the windows to the rear of the house either as the fumes enter and leave me dizzy/sick (a bit of a problem when the bathroom needs ventilated!). The flue looks rather blackened and the fumes are a side-product of burning and not fresh oil smell. I've pointed this matter out to him but he said he had his system serviced recently and it is fine. Can anyone suggest what might be wrong so I am better able to tackle my neighbour about it? Do I have any rights here?
