Can anyone tell me what is done should a country be found in breach of EU Law? Further, has there ever been a case of a private company being prosecuted under an EU Law that had not been enacted by the host country?
Well, Greece (among others) is fined on a fairly frequent basis for not implementing EU laws.
Dunno what you mean by a private company - Microsoft was fined by the EU for antitrust practices.
as for the second part, I was thinking that since EU directives have to be met by a certain date, if the country hasn't enacted them in theory they're still binding and i know people have sued states and semi-state companies and won on this basis. I wondered if there's ever been a case of a private company being sued in this manner.
