I was stopped for using my mobile by a traffic policeman on 7/1/08. I am already on nine points so he could not give me a ticket and said I would have to go to court. He took my details but did not give me anything nor have I had anything through the post yet. Does anybody know if there is a time limit on this regarding prosecution. Thanks

As I understand it you need to be given a NIP (Notice of Intended Prosecution) within a time frame (2 weeks I think) however as you were stopped by a policeman your NIP was given verbally so they are well within time constraints. You will get something through the post eventually.
the time limit,i believe is 6 months.but if im wrong ethel will correct me.
They have up to 6 months to take you to court, the sooner the better.
A postal NIP is not necessary when you have received a verbal NIP as you have.
Up to six months from the date of the offence to serve the summons to court.
yep as above, they have 6 months. If I was you I'd get down to Halfords they have a good deal on push bikes at the moment.

Further to Loosehead's suggestion, bear in mind also that although it is not a specified offence to cycle and use a hand held mobile phone, it is possible in that situation to be prosecuted for reckless or careless, and inconsiderate, cycling.

Thanks for the advice people, I know it was wrong and am not trying to get out of it, just wanted to know the time frame so I can plan ahead, like Loosehead says.


Thanks for those sentiments wizard66, its amazing how you have so much insight into me as a person and the circumstances of my offence from the few lines that I wrote.
I would like to enter into a civilised debate with you regarding your ability to have never done anything wrong in your life but I am sure you will be too busy casting the first stone towards anybody that is stupid enough to come anywhere near you, you goose stepping nazi pr!ck!

At what point have I tried to excuse my behaviour or suggested that I am above the law?
My "appalling record" of 33 35 36 in 30 zones during 75000 miles of driving, I would suggest, hardly qualifies me as a menace on the road.
Whilst I am equally appalled by your sons plight, perhaps a better use of your transference may be to apply to become a local magistrate, however that does mean having to modify your views slightly, so that they are based in reality!
Just out of curiosity how old are you?
