Advertising New Roles

Where can I find out the legalities of advertising newly designed roles? My company has almost 200 employees, but has recently developed 3 new roles and appointed staff into them (to stop the staff from leaving); without having advertised the roles or advising staff that the roles had been developed..the new roles have attractive salaries and had they been advertised they would have attracted some good internal candidates..surely this cannot be right? The company have also advertised 2 jobs at �18k - internally and externally; but have advised internal applicants that the salary is actually only �16k - can this be done?..

To answer the first part of your question, it is perfectly legal to give someone a job without advertising it, whether it be an exisiting job or a newly created one. Most Companies would advertise the position but they don't have to.

A managing director could create a new position and give it to his wife and there would be nothing you could do about it.

I don't know about the second part, is the job advertised externally as �18K or as c�18K or upto �18K?

What are the exact words on the ad regarding the 18k? The phrasing of this will be the most important, if it's a sliding scale and salary will be awarded based on experience it's a completely different issue but if you're advertising the job as having a starting salary of 18k & you're only prepared to offer 16k, I would advise you take legal advice before proceeding.
