garden fence

my neighbour has a four foot fence between mine and his garden.I want to put up a slightly higher one so that me and family can have a bit of privacy when we are outside. He is now saying that we cant as it would block the sun out of his garden (which it wont) I think that I can put one up. Can anyone tell meif I am allowed.

He's talking from where the sun DOESN'T shine - of course you can. Up to 2 metres high, without the need for planning permission, is permissible in the back garden. Just put it on your side, next to his fence.

We had a neighbour that said that to us once. We bought some of that willow screen higher which was higher than his fence and just ran it along the side of the fence. It looked lovely from our side and had nothing to do with the neighbour or his land so worked a treat.

its a load of bull!!! he should be grateful its a fence and not a brick wall!!! our neighbours erected the berlin wall 6 foot high to seperate our houses and we didnt make a fuss and it was a right sight! luckily we moved shortly after...xx

I have this issue and am putting up a higher fence than my neighbour - what you need to bear in mind which is the advice I got was that if the boundary fence belongs to them ie their responsibility - then you can put your fence up as advised above but you must not attach it to his fence ie it has to be independent of his even if it is right up to it. No nails or posts should be secured against their fence.

Even if it was your boundary and the neighbour had previously chosen to put a fence up his side, you can't go attaching your new fence to his existing one.
