Had she been 14 or him been a lot older, then fair do's, have a go, but we are talking about what is quite a normal age gap with couples.
Go with Randyraven on this - technically, yes, he committed a crime but the bigger crime is that he couldn;t put on a johnnie if you ask me. Given the amount of unwanted pregnancies and morning after pills dished out to under 16's these days, this is not isolated, and if it DOES go that far, priority concern will be you and the baby,

There is a limited statutory defence:
A man is not guilty of an offence under this section because he has unlawful sexual intercourse with a girl under the age of sixteen, if he is under the age of twenty-four and has not previously been charged with a like offence, and he believes her to be of the age of sixteen or over and has reasonable cause for the belief.

Home Officer papers 2003, 2004, 2005, 2006, 2007, 2008 and more than likely 2009 along with the Law Commission and CPS have all targeted sexual offences.
Hence the reform in 2003, hence the added statues.
They will try to get as many convictions as possible to make the figures look better. The law is the law - mitigating factors MAY keep him from Prision but he will be on the Sex offenders register if found guilty!
