I've also posted this in the Insurance sec as not sure which one) Been involved in a 2yr litigation battle (property dispute with land registry) with an ex which upto now has cost me a fair amount of money and we are now waiting to hear the adjudicators decision. I have just found out - typical- that for the past year I have had legal cover included on my home insurance. Am I too late now to try and claim any money back.
If when we receive the decision, dependant on the outcome, if I wish to appeal could I then sack the solicitors who are acting for me and ask for my insurers to take over - just a thought.

Jaycee my heart goes out to you. I was in the same boat. I discovered after the event, that I had legal expenses cover via my house insurance all along. I went through the horror of representing myself in court (and failed miserably) as I could not or was not prepared to pay extortionate solicitor fees. It haunts me every day.

Read your policy booklet. Mine said I had to make a claim within 6 months of the incident. So you may not be entitled to help at this late stage. I highly doubt they will repay your existing costs.

I am also using my legal cover to sue Welsh Water. The procedure was that I contact the insurance legal helpline which goes direct to their appointed solicitors. They review the case, see if it is covered by the policy and they do the required work.

I also read if there was no solicitor in the area you could choose your own. In some cases you would see if you had a case, and pay the solicitor upfront, to be reimbursed by the insurance company if they thought you had a case.
Oh I highly doubt that exising cases will be covered. So if you been in battle with Land Registry for 2 years but have only had the insurance for one year, then I suspect the answer would be that you are not entitled to the cover for that case.
your policy is most unlikely to cover you for anything that had happened before the policy was in place

thanks for replies, I thought that may be the case bednobs but I rang them before and they asked me to fax relevant paperwork which i have, so we will wait and see, I wont hold my breath tho.
Jedimistress Im really sorrry you failed, sometimes theres just no justice! I don't know yet whether I have won or not, Im still waiting for the Adjudicators decision, been waiting 5 weeks now everyday I keep thinking I will hear something today, but never do. Good luck with Welsh Water.
