Just to let you know that mrwarpig called thepolice last night and they will not be paying for the repairs/replacement of the door.

As Annlinda said before, apparently because the police went to the Sheriffs court and got a warrant they have satisfied the Sheriff that there was cause to enter (even though they found nothing).

Mrwarpig has told the tenant that she must pay for the repairs to the same standard as were there previously. Whether or not he allows her to stay on is his call (thankfully).

pretty much as i thought warpig. What has the tenant said to the suggestion that she pays?

Not being funny but has mr warpig checked the property recently? It may have been a good excuse to visit it and do a quick spot check.

My neighbour moved back in yesterday! god knows whats going on there, i hope they get eviction notice served soon.

He is going to call up this weekend and check the property over but as she knows he is coming I am sure it will all be in order.

She didn't seem too amused when he said she would have to make the repairs! She stated that she only got �50 per week on benefits. But that is not his problem, he is a bit of a softie at times and I had to remind him that this was not of his making and he is not a charity. Whether she only receives �50 or not is anybodies guess. She does get her rent in full so I imagine that she is on income support which I would have thought was more.

Your neightbour is back!!!???? How can that be after being busted? Is it a council property? If so maybe there are certain provedures they must go through before removing her. Sad thing is, if she is removed it will only move the problem on (but at least it will be away from you!).
yeah its social housing so she can come and go as she pleases til the get eviction sorted. I just hoped that she had gone early if you know what i mean.

She will probably get put in some bedsit somewhere, hopefully full of similar types so they can all annoy each other lol

I reckon your tenant must be on more than �50 a week, especially if dealing drugs! even if she knows shes getting an inspection visit chances are (if anything like my neighbour) she wont care about tidying up.

i hope its all ok though and you get no trouble

I must admit when she said she only had �50 a week I did stifle a laugh. Maybe I am just too cynical.
she must be getting more than that surely. Look how many work out they are better off not working, must be something in it.

Thats what I thought too. The only bill she has to pay is electric as rent and council tax are covered by her HB. Its only a tiny one bedroom flat so I am sure the electric wouldnt be that high. She will have to fund the repairs from somewhere though as there is no way mrwarpig is paying for it (whatever he may think).
Warpig, I'm baffled by all this. Surely the police cannot deny liability if nothing criminal is found. Not a legal answer but I would guess that they have to make good the damage if no reason to enter is found. In the case of a suspected gas leak they dont even need a warrant. Not sure what would happen if no leak was found. Send them a bill stating that if it not paid within 14 days you wiill take further action which will of course include your legal expenses.

Johnny, I get where you are coming from completely but it would appear that the police have it all 'sewn up' to cover themselves in the event nothing is found. Unfortunately under the data protection act they would not give mrwarpig any info as to what was going on that prompted them to raid the flat. The tenant rang looking for info under the freedom of information act and they wouldnt give her any (even though it related to her) as it may hamper ongoing enquiries.

I agree its all very strange but it seems that there is no right of redress when it comes to the police.
