DVLA Fine, lawful or not?

A friend has recently had a fine for not taxing or SORNing a vehicle. Said vehicle was scrapped 3 years ago.
DVLA seem to assume the car has been kept/ used on the road, when it clearly hasn't.
The old theory of innocent till proved guilty doesn't seem to apply to DVLA.

Oviously the V5C/3 part of the registration was never received by the DVLA , advising them that the vehicle had been scrapped.

Did your mate not send it off or could it have been lost in the post?
if you send anything to the dvla , send it by recorded post
