How long to leave a reply to a divorce petition

My partner has, at last, completed his divorce papers and they have been sent off to the courts with payment. These papers have now been forwarded to his ex and she has had them since 9th June 2008.

Has anyone come across the problem where the ex just "hasnt got round" to signing the papers but said they would. Not too sure how long to leave it before taking the next step and possibly asking for the baliffs to get involved .. an option with the courts! I dont know if they are purposely not being signed or genuinely forgot. My partner has mentioned them to her again and she said she will do it!!!!

The fact remains that your partner's ex-wife cannot be compelled legally to sign anything. As the saying goes: "You can lead a horse to water but you cannot force it to drink". In the circumstances it is up to the court to decide what action is to be taken, and involving bailiffs is not the answer. What are they expected to do anyhow ? My simple advice is this: your partner may wish to consult with his Solicitor regarding the problem who may, in turn, write to the Solicitor representing your partner's ex-wife and you can all take it from that point. Otherwise there is nothing more anyone can do. Divorce can be a lengthy drawn-out process.

My ex stalled for nearly 6 months.
My circumstances were extreme and eventually his solicitors told him he should sign or it will cost him a mint.

The divorce has been done personally and solicitors have not been involved. She has recd the petition to which she now signs it and he has been sent a copy of what she has with a covering letter mentioning baliffs can contact her if she does not sign! I genuinely think she has just forgot but maybe my paranoia is getting the better of me living with someone (and having a baby) who is classed as married. Silly me .....

I did my own divorce and my ex husband stalled on signing them. I can't remember how long it was exactly but the bailiffs went to serve them and he wasn't there so I think they left a message for him and he never returned the calls. I think from what I can remember he didn't respond to the bailiffs so I think you can apply for permission to be granted without his consent by a judge. My memory is useless, it was only last year ;-)
