Olives, stones, teeth
I went to a restaurant and bit down on an olive containing a stone. There was no mention either way on the menu, i.e the menu had not mentioned the presence, nor the absence of stones. Is the restaurant responsible? Is there any legal obligation to inform customers of the danger?

Because someone will try and sue. The world has gone absolutely barmy and people seem to have forgotten to use common sense.

I believe there is a little known law - Olives and Stones 2007 which Paragraph 1 section 1 states that if you eat Olives there may be stones in them. There lies the obligation.
I think you can find it together with The Taps And Hot Water Act which states that the Hot Tap May Contain Hot water and the Nuts and Allergies Act which states Nuts ...... contain Nuts !

I think they should have put a warning on the table in big letters, plus a warning that you could get a paper cut from the menu, or that you could possibly be allergic to the flowers on the table or that you should not drink more than eight pints of water or you could die. I was in America recently and they have an advert where a car is driving on the edge of a skyscraper with two wheels off the edge and underneath they have put "real cars cannot drive on the side of buildings this is only a fantasy". I rest my case.
oh diddums. I hope they had plastic knives and forks so you didn't accidentally self harm, and a bib to tie round your neck so you didn't accidentally spill something on your tank top (the tank top with the slogan 'I'm a raving idiot' ), and a sign saying 'danger of choking, please chew every mouthful at least 25 times before swallowing'.
Life is a risk just by being alive.
Most of us have had bad luck of this kind at one stage or another. Put it down to experience. It's unfortunate but one of those things.
It's people trying to make silly insurance claims like this that has resulted in the ludicrous situation we have today whereby teachers won't take kids on school outings for fear of health & safety risks, councils won't allow open air carol services to take place for fear a Christmas tree will fall over and injure somebody, and men are frightened to wait outside the school gates to pick up their kids in case somebody thinks they're a paedophile.
Heaven protect us! What happened to good old fashiloned common sense?

You are all so wrong... My sister did this and broke her tooth, one she had for forty years resulting in an expensive capped tooth, one of no doubt at least 2... The restaurant have a duty of care. They either have to advise clients via the menu or ensure olives are PITTED !
Negligent. I'll say so.,.

All of these negative comments are natural as they obviously havent had a tooth broken by an olive stone!! Of course the restaurant is liable! Some olives are already pitted and some are not just like in the supermarket! ..it's up to the restaurant to tell you. You have the inconvenience and the pain to deal with and I would say write them a letter and if no reply then consult a solicitor.
