IBM think pad powers down and turns its self for no particular reason at differing lengths of time.., even though the battery shows charged and its connected to the mains , could it still be a duff battery ? or any other suggestions ? its used on a desk so shouldnt be an overheating problem although not 100%

I suspect that it is a overheating problem. your heatsink and fan is probably nicely clogged up with dust.
