I am divorcing and want to buy my husband equity out  and change the property deeds to my sole name.  I am the only one on the mortgage.

Will I need to pay stamp duty on his share?

Telephone 0845 6030135 and discuss your exact circumstances direct with the Stamp Duty office whom you will find to be very helpful.
If you are paying money for the share then you might, but you may still have the exemption that u are married. If you are simply taking over the mortgage then definitely no.
