Hi My husband and i have been separated since april 07 I moved out of our family home as it is next door to his mum (big mistake!) I rent a small house with my 2 children 4 & 7 and he lives part time in my old house and part time at his girlfriends house. He has ignored every letter from my solicitor and has refused to sell and refused to mediate etc etc etc he now no longer pays for the children hardly ever asks to see them and now due to housing market at the mo donlt have much chance of selling the house even if he would put on market there would have been about 90K equity a year ago but now more lilke 60k Solicitor crap just wants my money! Has anyone ever had experience of this????? Just want enough money to buy somewhere for me and the kids If it goes to court what will happen he is saying he can;t afford the mortage but does not pay any maintenance for the kids, I can;t move back in if he leaves the house i can;t force him to sell???? Please any help would be appreciated!!! Thanks

Assuming the house is owned jointly, you can apply to the court for an order of 'division and sale'.

The court will not refuse especially as the children don't live there. Ask your solicitor about this particular point.
I wish u the best of luck. I wish I could offer advice but all I can say is dont feel alone. My husband walked out on me and my 2 year old June 07 and cleared the whole house out, took car, cut every billoff including the phone. He is now living the bachulor life and I am wandering how the next bill is going to be paid. Hopefully life will get better for us!!
