a man assulted me and has been charged with section 20 gbh. he has pleaded not guilty but there is cctv footage that he hit me. he has witnesses saying that the attack was provocted. will this lessen his sentence if the court feels he was provocted or will the sentence be worse as he has pleaded guity and the footage clearly shows he assulted me? thx

Did he plead guilty or not guilty - you seem to indicate both?

As far as I'm aware provocation is not a valid defence. Self defence can be.

sorry yeah he has pleaded not guilty at magerstrates so ive been told it will go to crown , he has been done before for either gbh or abh but didnt get sent down. would appricate any answers thx
Hi davve2 If the blokes pleading not guilty and goes to trial and is found guilty as I think he will with cctv evidence then he's looking at doing time.12-18 months.
I was convicted for G.B.H. I was lucky only being done for common assault before and pleading guilty was in my favour.I ddn't go down but what a worry
