Can I Avoid A Prison Sentence

Hi , back in january my gran had jsut passed away and me and my 2 brothers were sitting together having a chat,when my younger bro received a phone call threatening him and saying they were gonna shoot him and cussing about our gran being dead , they then told us to go over and gave us there adress ( so being complete idiots we did) anyhow i picked up a piece of ply wood outside these guys house and we knocked on the door and they let us in my young bro stood with the 1 lad at the door , and my otehr bro went into lounge and hit this otehr lad as he was going for knifes he had sitting on teh table in front of him ,anyhow i smashed a few ornaments and on my way out of teh house this lad that was by front door told me my kids were gonna be next to my gran so i swung the piece wood hitting him across the chest area ,( he received no medical attentention as he had no severe injuries, now the cps offered my lawyer a bargain asking me to plead guilty to hitting the lad bthat required no treatment as the injuries were not severe enuff , but my lawyer turned it down hoping to get a better deal next thing i know im up in court on trial next mth i am a single parent with sole custody of my 3 young kids i have no one else to even look after them for that day , but can i avoid going to prison cause if i do then my kids will more than likely go into care ?? any suggestions or advice ??i know i haev been stupid in this incident i shud of ignored it and acted like a grown up

since this incident i haev moved into a nice house with my kids and i have not had any contact watsoever with my 2 brotehrs who both have a few charges before this one , i moved and told myself i aiont going down teh same road , yes wat i done was wrong i admit that it was stupid i aint no thug one night of supidness i am sorry very sorry but sorry dont seem to cut it with sum ppl tehre is no forgiveness even when someone is genuinly sorry like me

When you are in prison go on a spelling course, you will have the time and you wont have to spend your beer money on it.

Kinell i really dont understand you , because someone makes a mistake it seems in your eyes there the devil basically this is my 1st offence last year was a set up and the judge seen that n it was chucked , i mite of commited an serious crime but its not one im proud of and dont come and tell me you have never done anything wrong in your life

This person has came on AB for help and advice and for the best part all he has had is abuse.I would suggest that some of the posters should look at themselves rather than berate someone who in my opinion seems genuily contrite.

Anyway -assuming this is a first offence I think you will get community service -or a heavy fine and a compensation order.They dont tend to imprison in Scotland for 'first' offences and they will take on board that you were 'baited'.

We all make mistakes -every one of us so dont be too down on yourself -I think that you should go with your solicitor -they are hand in glove with the Sherriffs and the PFs in the main -I have witnessed it as I have had to attend court myself a couple of times this year-in Scotland -I wasnt in the dock.

Why should human society have to tolerate these people who choose to live outside the basic structure of civilised community.

People who use violence are the dregs and the scum and should be kept seperate in their own cage and prevented from growing offspring in their own image.

Accept your fate - hopefully prison because then you will think first before you hit someone (else) with a plank of wood - and once inside do something constructive; I recommend literacy lessons
It's unlikely your children will go into care with family around to help out, but then really, you should think of these things before lashing out

Good luck Bastian, I actually admire your courage and can see that you do regret your error. As has already been said, put on a contrite air in court and accept whatever they say about you with a good grace and you should be fine.

If you want any advice, and I'm not sure that you really need it, I would simply remind you to put your children's needs first at all times. You will be OK, of that I'm pretty confident.

Hopefully the justice system and the courts will be a good place to start.

Youre correct it probably wont happen all the time we have a lefty attitude and lightweight sentencing.

I personally would say that this person has been very honest is holding his/her hands up and I really dont think he/she is a bad person -there are a lot of mitigating circumstances here.

maybe you would of stood a better chance of getting off with it if you hadn't picked up a plank of wood, this shows your intent to hurt someone with an offensive weapon, the fact that he only suffered bruising is a god send to you as you could of been looking at GBH or worse.

tell the court that you have moved and that your not associating with the others involved and that your trying to sort your life out

this will show that you have realised what you did was wrong and are sorry for yur actions and they may take pity on you
