Work still not finished

As a update to my earlier posting " Extension still not finished 7/1/09" The builder has still not returned to complete work/clean my garden or bother to contact me after I left a message with his father on 2/1/09..
The guttering that used to drain water off both properties in a central downpipe is still not modified( the open outlet minus the downpipe is still discarging water over my wall)Could this lead to damp or in freezing conditions crack my rendering.

Sorry Zac .didnt mean to mislead.My neigbour has had a single story extention built.Work started in late June 08 and is 99% finished apart from the guttering downpipe.He had access to my property for building works and has left building rubbish uncleared.
