where do i stand with my ex?
my partner and i split up 2 yrs ago. we remained friends up until about 6 mths ago. he saw me out with a guy and he then started harrassing me which lead to him been charged with 12mths probation & 12mths restraining order. the day after he got charged i received a letter from his solicitors stating he paid some credit cards and a loan off for me and now he wants the money back. He states we had an oral agreement about if we split up what would happen. He did pay these items but there was no conversation between us. Where do i stand. Please help

For more on marking an answer as the "Best Answer", please visit our FAQ.This happened in America a while ago, and the judge found for the person claiming- but that was because the lady had been talking to the person since the split and informally agreed (either via email or text, I forget which) that she would pay him back. It was along the lines of 'yeah, I know owe you' or some such "proof".
If he doesn't have any proof of this kind at all, this will be much harder to prove. I wouldn't say you're 100% safe on this (although I know that's what you need to hear), but my advice is just to ride it out. Without evidence, it is unlikely on the 'balance of probabilities' he can prove you had the 'intention to create a legal relationship'- and he would need to show this in order to prove you two had a contract, however informal, between you.

I actually contacted the police to ask where I stood because I feel all this is just him trying to get to me again but the police said he is going through the right channel by using a solicitor so cannot do anything.
I don't think he is paying for the letters from the solicitors cos he is not working so he'll get legal aid. I can't afford a solicitor so i'm trying to deal with this myself.

nothin' like a man scorned.....'cause he's seen you with another guy he wants his gifts back! Tell his solicitors it was 'payment in kind'. After all, you must have 'done' for him; washed his smelly clothes/ cleaned his dirty home / bought & carried his unhealthy food & booze / put up with his foul-mouthed mates / kept awake nights with his wingeing / nursed his in-growing, fungal toenails / lived with his smelly feet & sock / had to cook in his fart-filled kitchen / put up with his farting around you / his vomiting drink he couldn't hold / peeing in the cupboard & basin.....am tired now & the tv is more interesting ;-)
